Terms of Service
Effective Date: April 2026
These Terms of Service ("Terms") govern your use of the Fourex Customs website and your purchase of products from Fourex Surface Restoration, LLC, doing business as Fourex Customs ("Fourex Customs," "we," "us," or "our"). By using our website or placing an order, you agree to these Terms.
Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order.
Products
We make every effort to display our products accurately, including colors, grain, finishes, and dimensions. However, because each piece is handcrafted from natural hardwood, there will be natural variation between pieces. Wood grain, color, and figure will differ from the photographs shown and from one piece to the next. These variations are characteristics of handmade hardwood products and are not defects.
Pricing and Availability
Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, refuse or cancel any order, and limit order quantities.
Sales Tax
We collect Florida sales tax on orders shipped within Florida as required by law. Out-of-state orders are not currently subject to sales tax collection by Fourex Customs; you may be responsible for use tax in your state.
Payment
Payment is due at the time of order. We accept the payment methods shown at checkout. Orders will not enter production until payment is confirmed.
Customer Content and Intellectual Property Warranty
This section applies any time you provide a logo, image, artwork, design, monogram, crest, name, phrase, signature, or any other content for us to reproduce or incorporate into a product ("Customer Content").
Your Warranties. By submitting Customer Content, you represent and warrant that:
- You own all rights in and to the Customer Content, or you have obtained all necessary rights, licenses, consents, and written permissions from the rightful owner(s) to submit the Customer Content and to authorize us to reproduce, modify, and manufacture it on a product;
- Your submission of the Customer Content, and our use of the Customer Content to fulfill your order, will not infringe, misappropriate, or violate any copyright, trademark, trade dress, right of publicity, right of privacy, contract, or any other right of any third party, and will not violate any applicable law;
- The Customer Content does not contain defamatory, obscene, unlawful, or otherwise objectionable material.
Indemnification. You agree to indemnify, defend, and hold harmless Fourex Customs, Fourex Surface Restoration, LLC, and their respective owners, officers, employees, contractors, and affiliates from and against any and all claims, demands, lawsuits, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) any breach of the warranties above; (b) any third-party claim that the Customer Content or our use of it infringes, misappropriates, or violates any intellectual property right, right of publicity, right of privacy, contractual right, or other right; or (c) any claim by a club, organization, brand, team, league, or individual whose logo, mark, name, likeness, or design appears in the Customer Content.
Our Disclaimer of Liability. Fourex Customs disclaims all liability for any claim arising from Customer Content supplied by you. We do not independently verify the ownership of, or permissions relating to, any Customer Content submitted by a customer. Responsibility for securing any and all necessary rights rests entirely with you, the customer.
Our Right to Refuse. We reserve the right, in our sole discretion and without liability to you, to refuse, cancel, or halt production of any order involving Customer Content that we believe may infringe third-party rights, violate the law, or otherwise be objectionable. In such cases, we will issue a refund of amounts paid for the affected item(s).
License to Use Customer Content. You grant Fourex Customs a non-exclusive, royalty-free, worldwide license to reproduce, modify, and use the Customer Content solely for the purpose of producing and delivering your order. Fourex Customs will not use your Customer Content for marketing or promotional purposes (for example, in photos, social media, or portfolio pieces) without your separate written or electronic permission.
Our Intellectual Property
All original designs, product photography, website content, logos, and branding owned by Fourex Customs are the property of Fourex Surface Restoration, LLC and may not be reproduced, copied, or used without our prior written permission.
Warranty Disclaimer
Except for the express 30-day warranty set forth in our Return & Refund Policy, all products are sold "as is" and we disclaim all other warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, in no event shall Fourex Customs, Fourex Surface Restoration, LLC, or any of their owners, officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from or related to your use of our website or products, even if advised of the possibility of such damages. Our total liability for any claim related to a product shall not exceed the amount you paid for that product.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your purchase shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. The "Effective Date" at the top reflects the most recent revision. Your continued use of the website or placement of an order after changes are posted constitutes your acceptance of the revised Terms.
